Terms of service

GENERAL PROVISIONS

These terms (hereinafter – the Terms) constitute an agreement between MB Itališko skonio dėžutė, legal entity code 307210659, registered office address Perkūnkiemio g. 15-65, 12119 Vilnius (hereinafter – the Seller) and you, under which the Seller will enable you to purchase the goods (hereinafter – the Goods) and gift vouchers (hereinafter – the Gift vouchers) offered in the online shop at http://www.italiskoskoniodezute.lt/ (hereinafter – the E-shop).

You are entitled to purchase in the E-shop only if, under the applicable laws, you are able to enter into a binding contract with the Seller, and only if you comply with these Terms and the applicable laws. If you are under 18 years of age, you may purchase in the E-shop only with the consent of your parents or other legal representatives. By placing an order, you confirm that you are 18 years of age or older or that you have the consent of your parents or other legal representatives.

PURCHASING IN THE E-SHOP

When you visit the E-shop and select Goods, a shopping cart is formed on the basis of your selection.

Once the cart has been formed, you must enter the data required for the delivery of the selected Goods. Make sure that the data provided is correct and that the Goods ordered correspond to your wishes. You have the opportunity to correct any errors, if there are any, before confirming the order. The data you provide is processed for the purposes and in the manner set out in the Privacy Policy.

You agree that, by placing an order in the E-shop, you undertake to pay the price for the Goods indicated in the order. The price of the Goods indicated in the E-shop and in the order includes all taxes, but does not include the delivery charge for the Goods, which you will have to pay additionally (unless otherwise indicated in the E-shop). Prices in the E-shop and in the order are indicated in Euros.

You may pay for the Goods by the following methods: online banking, credit card, bank transfer, or other methods indicated in the E-shop.

Payment must be made immediately after the order is placed.

Once you confirm the order, the Seller receives all the information about it. The order is deemed to have been placed from the moment it is received by the Seller. In such a case, a contract is also deemed to have been concluded between you and the Seller. However, the Seller is obliged to perform such a contract only from the moment the Seller receives confirmation from the payment service provider of the payment for the Goods.

After the order has been placed, an email will be sent to the email address you have indicated, listing the Goods ordered and the data you have provided.

Upon receiving notification that you have paid for the Goods ordered, the Seller undertakes to fulfil your order.

This section of the Terms also applies to the purchase of Gift vouchers.

CHARACTERISTICS AND QUALITY OF THE GOODS

The characteristics of the Goods are indicated in the E-shop next to the description of each item. The Seller seeks to ensure that the Goods comply with the requirements laid down in legal acts and are fit for use for their intended purpose.

By placing an order, you confirm that you are aware of and understand that the Goods displayed in the E-shop may differ in colour, shape or other parameters from the actual size, shape and colour of the Goods due to the characteristics or settings of the monitor or other device you are using. Such differences will not be considered defects of the Goods, except where the discrepancies are caused by the actions of the Seller or third parties related to it.

The Seller undertakes to deliver Goods that correspond to the information provided in the description of the Goods in the E-shop. The Seller also undertakes to deliver to you the assortment and quantity of Goods specified in the order, but is not liable in cases where the assortment or quantity of the Goods delivered is inaccurate because you provided incorrect data in the order submitted to the Seller.

DELIVERY OF THE GOODS

When ordering Goods, you must select the delivery method for the Goods and indicate the delivery address. Delivery is available by the following methods: by courier, to self-service parcel terminals.

Please note that the delivery times indicated for the Goods are indicative. Although we always strive to fulfil orders as quickly as possible, preparation may sometimes take longer due to a high volume of orders or the workload of delivery service providers. The Seller always provides information on the delivery status; please follow this information. Once the parcel has been dispatched, you can track it by its parcel number in the delivery service provider's system.

If, upon accepting the Goods, you notice that the parcel does not contain the Goods ordered, inform the Seller immediately.

The Goods are delivered packaged according to their nature, so that the Goods are fit for use for their intended purpose.

EXCHANGE OR RETURN OF GOODS

Withdrawal from the contract within 14 days (applies to consumers only)

If you purchase in the E-shop as a consumer (i.e. a natural person acting for purposes which are outside your business, trade, craft or profession (for consumption purposes)), you have the right to return the Goods or Gift vouchers purchased in the E-shop (as long as they have not been used) within 14 (fourteen) calendar days from the day on which you received the Goods or the Gift voucher. You may do so without giving any reason (i.e. by exercising your right to withdraw from a distance contract, which is granted to you by the laws of Lithuania and the European Union). 

Please note that the E-shop offers Goods which fall within the exceptions provided for in Article 6.228(10), Part 2 of the Civil Code of the Republic of Lithuania, in which case consumers do not have the right of withdrawal discussed in the preceding paragraph. Accordingly, you may not withdraw from the contract and return, without giving a reason, Goods which are perishable or have a short shelf life (for example, food products and beverages with a short expiry date), as well as packaged Goods which, once unpacked, are unsuitable for return for health protection or hygiene reasons.

If you withdraw from the contract, the Goods you return must be unused, with their labels and in the original packaging, undamaged and without loss of their marketable appearance. We will consider that you have met this requirement if, when examining the Goods, you have only performed such actions as are necessary to assess the Goods and as you would normally perform when inspecting the Goods in a physical shop.

To exercise this right, you must notify the Seller by email no later than within 14 (fourteen) calendar days from the day of receipt of the Goods or the Gift voucher and attach proof of purchase. You may use the sample return notification form provided here.

Having decided to withdraw from the contract, you must, without undue delay and in any event no later than within 14 (fourteen) calendar days from the day on which you notified the Seller of the return by email, send the Goods back to the Seller at the address indicated at the beginning of these Terms, and, in the case of a Gift voucher, irreversibly delete the Gift voucher and its data. The deadline will be deemed to have been met if you dispatched the Goods before the expiry of the 14 (fourteen) day period. You must bear the costs of returning the Goods to the Seller.

If you withdraw from the contract, the Seller undertakes to refund, to the bank account indicated by you, all sums paid by you for the Goods and for their delivery to you no later than within 14 (fourteen) calendar days from the day on which you notified the Seller of the return by email, but not earlier than the Seller receives the returned Goods (unless the Seller, at its own discretion, decides not to wait for the returned Goods).

Wholesalers and other buyers who purchase in the E-shop for purposes other than consumption do not have the right to withdraw from the contract, unless expressly agreed otherwise with the Seller in writing.

Goods of inadequate quality

Where a best-before (use-by) date is set for the Goods, the Seller delivers them to you in such a way that you can use the Goods until the end of that period, and is liable for the quality of the Goods until the end of that period, provided that the Goods have been stored under the prescribed conditions.

If Goods purchased in the E-shop are of inadequate quality, you have the right, in accordance with the procedure and within the time limits laid down by law, to request that the Seller remedy the defects of the Goods free of charge or replace the Goods of inadequate quality with Goods of adequate quality, and, in the cases provided for by law, to request a corresponding reduction of the price or to return the Goods.

If you consider that Goods purchased in the E-shop are of inadequate quality and have identified their defects, you must, no later than within two months from the day the non-conformity was discovered (or, in the case of perishable Goods or Goods whose shelf life is 

short – immediately, before the natural spoilage of such Goods has begun, but no later than within 72 hours), notify the Seller by email of this and of your preferred remedy. When reporting Goods of inadequate quality, provide a detailed description of where and when the defect occurred, attach photographs of the Goods and the defect, and any other related information that will help to identify the defect. 

The buyer's rights in respect of Goods of inadequate quality are exercised in accordance with the procedure laid down in Articles 6.364(1) to 6.364(3) of the Civil Code of the Republic of Lithuania.

GIFT VOUCHERS

Gift vouchers are valid for the period indicated on them. The recipient of a Gift voucher must use the Gift voucher in the E-shop, i.e. pay with the Gift voucher for the Goods offered in the E-shop, within the period indicated on the Gift voucher. If the Gift voucher is not used within the period indicated on it, the indicated period is not extended, the Gift voucher expires, and the money paid for the Gift voucher is not refunded. Gift vouchers cannot be exchanged for cash.

INTELLECTUAL PROPERTY

The trademarks and other signs used to mark the Goods and Gift vouchers belong to the Seller and/or other persons and are protected by law. All intellectual property rights in the Goods and Gift vouchers and their individual parts also belong to the Seller and/or other persons.

The trademarks and logos used in the E-shop, the domain name, the E-shop itself and the website on which it is hosted, as well as all their individual elements, including texts, photographs, drawings and all material contained in the E-shop and on the website, the presentation, appearance and design of any page of the E-shop or the website, and all intellectual property rights therein belong exclusively to the Seller and/or other persons. You undertake not to copy, modify or otherwise use these intellectual property objects without the separate written consent of the rights holder.

LIABILITY

The Seller's liability for the quality and delivery of the Goods is established by the applicable legal acts.

You must provide the Seller with all the requested information, which must be correct and complete. You are responsible for indicating the correct delivery address for the Goods.

AMENDMENTS AND TERMINATION

The Seller may amend these Terms from time to time. The latest (current) version of the Terms will always be visible and accessible in the E-shop. Before confirming an order, you must familiarise yourself with the version of the Terms in force at that time. Each order will be governed by the version of the Terms that was in force at the time such order was confirmed.

The Seller will have the right to discontinue (terminate) the operation of the E-shop at any time. Such termination will not affect the purchase and sale contracts in force at that time.

OTHER TERMS

These Terms and any purchase and sale contract are concluded and shall be interpreted in accordance with the laws of the Republic of Lithuania.

Any disputes, disagreements or claims arising out of or in connection with these Terms or an individual purchase and sale contract, as well as questions of their breach, termination or validity, shall be resolved in the courts of the Republic of Lithuania in accordance with the procedure established by the laws of the Republic of Lithuania. The body for the out-of-court resolution of consumer disputes that is competent to resolve consumer disputes arising from these Terms is the State Consumer Rights Protection Authority (address: A. Goštauto g. 12, LT-01108 Vilnius, tel. A complaint to Lithuanian and other EU Member State authorities may also be submitted via the online dispute resolution platform https://ec.europa.eu/odr/.

All warnings or other notices relating to purchases in the E-shop and to these Terms will be given by email (when sent to the Seller – to the email address indicated at the beginning of the Terms; when sent to you – to the email address provided at the time of the order).

If any provision of these Terms is or becomes wholly or partly invalid, this shall not affect the validity of the remaining provisions.
